TERMS & CONDITIONS

1. Introduction

These Terms & Conditions (“Terms”) govern your use of this website and participation in the “Pass It On” campaign (the “Campaign”) operated by Jacob’s (“we”, “us”, “our”).

By accessing this website or submitting an entry, you agree to be bound by these Terms.

2. Eligibility

To participate in the Campaign, you must:

  • Be aged 18 years or over; and

  • Be a resident of the island of Ireland (being the Republic of Ireland and Northern Ireland).

We reserve the right to verify eligibility at any time and to refuse or disqualify any entry that does not meet these requirements.

3. Campaign Description

The Campaign allows users to submit a message or story and send a pack of biscuits to a chosen recipient.

  • Submission does not guarantee acceptance, fulfilment, or delivery.

  • All entries are subject to moderation and may be rejected or removed at our sole discretion.

  • The Campaign is limited to a maximum of 1,800 fulfilled recipient packages across the promotional period.

  • Participants must obtain the recipient’s permission before submitting their personal details.

  • Recipient delivery addresses must be located on the island of Ireland (being the Republic of Ireland and Northern Ireland).

4. Entry Limits

  • Entries will be accepted on a first come, first served basis while stocks last and subject to availability.

  • A maximum of 1,800 recipient packages are available as part of the Campaign.

  • Submission of an entry does not guarantee fulfilment or delivery.

  • Participants may submit a maximum of three (3) entries during the Campaign Period.

  • Each submission may relate to one recipient only.

  • Jacob’s accepts no responsibility for failed, incomplete, corrupted, or delayed submissions for any reason.

  • The Campaign opens on 11 May 2026 and closes at 11:59pm on 29 May 2026 (“Campaign Period”).

  • Entries submitted outside the Campaign Period will not be accepted.

5. User Content Requirements

By submitting content, you warrant that:

  • The content is original and created by you;

  • It does not infringe any third-party rights (including intellectual property and privacy rights);

  • It does not contain unlawful, defamatory, offensive, or inappropriate material.

We reserve the right to reject, remove, edit, or refuse any submission that we consider, in our sole discretion, to be inappropriate, offensive, misleading, defamatory, discriminatory, unlawful, or otherwise inconsistent with the spirit of the Campaign.

5A. Recipient Consent

By providing recipient details, participants confirm that:

  • They have the recipient’s consent to share their personal information with Jacob’s for the purposes of administering the Campaign;

  • The recipient is aged 18 years or over, or the participant has appropriate authority to provide the information; and

  • The information supplied is accurate and lawful.

Recipient data will only be used for Campaign fulfilment and related administration in accordance with the Privacy Policy.

Recipients may be contacted solely for the purposes of Campaign administration, fulfilment, or delivery.

6. Licence to Use Content

By submitting content, you grant Jacob’s a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, publish, display, and distribute your submitted content in connection with the Campaign and related promotional, marketing, and advertising activities across digital, social media, print, and other media channels.

You acknowledge that no compensation will be payable for such use.

Where reasonably practicable, Jacob’s may edit or adapt submissions for formatting, moderation, or production purposes.

7. No Purchase Necessary

Participation in the Campaign is free. No purchase is required.

8. Fraud and Misuse

We reserve the right to disqualify any participant who:

  • Attempts to circumvent entry limits;

  • Provides false or misleading information; or

  • Misuses or interferes with the operation of the website or Campaign.

9. Website Availability

We do not guarantee that the website will be available at all times or free from errors. We may suspend, withdraw, or modify the website or Campaign at any time without notice.

10. Limitation of Liability

To the fullest extent permitted by law, Jacob’s shall not be liable for:

  • Any loss or damage arising from website unavailability or technical issues;

  • Lost, delayed, or incomplete submissions;

  • Failed or delayed deliveries;

  • Any indirect, incidental, or consequential loss or damage.

Nothing in these Terms excludes liability where it cannot be lawfully excluded.

11. Changes to the Campaign

We reserve the right to modify, suspend, or terminate the Campaign at any time without prior notice.

11A. Right to Suspend, Cancel or Close the Campaign Early

Jacob’s reserves the right, at its sole discretion, to suspend, withdraw, modify, cancel, or close the Campaign early at any time where circumstances arise outside its reasonable control or where necessary for the fair and proper operation of the Campaign, including but not limited to:

  • Technical issues;

  • Fraud or suspected fraudulent activity;

  • Misuse of the Campaign;

  • Operational difficulties;

  • Fulfilment or supply shortages;

  • Website failures;

  • Cyber incidents; or

  • Any other cause that compromises or may compromise the administration, security, fairness, integrity, or proper conduct of the Campaign.

Jacob’s shall not be liable for any loss, disappointment, inconvenience, or damage suffered by participants or recipients as a result of such suspension, modification, cancellation, or early closure, to the fullest extent permitted by law.

12. Food & Allergen Disclaimer

Products distributed as part of the Campaign may contain allergens.

While ingredient information is available on product packaging, Jacob’s does not guarantee that any product is free from allergens, including but not limited to:

  • Nuts

  • Peanuts

  • Dairy

  • Gluten

  • Eggs

  • Soy

  • Sesame

Participants are responsible for ensuring that any recipient is aware of potential allergens.

Consumers must review product packaging and ingredient information prior to consumption and should not rely solely on Campaign-related materials.

To the fullest extent permitted by law, Jacob’s accepts no liability for any allergic reactions or adverse effects resulting from consumption of products associated with the Campaign.

13. Recipient Responsibility & Accuracy

Participants are solely responsible for ensuring that all information provided, including recipient name, address, and contact details, is accurate and complete at the time of submission.

  • Entries cannot be amended once submitted.

  • Jacob’s accepts no responsibility for incorrect or incomplete information or for any resulting failure or delay in delivery.

14. Fulfilment & Delivery

Where products are sent as part of the Campaign:

  • Delivery times are 3–4 working days; these are estimates only and are not guaranteed;

  • Deliveries may be affected by factors outside our control;

  • We are not responsible for delays, losses, or failed deliveries caused by third-party providers or incorrect information supplied by participants.

Jacob’s does not guarantee delivery by any particular date or occasion.

Deliveries are limited to addresses located on the island of Ireland only (being the Republic of Ireland and Northern Ireland).

Jacob’s reserves the right to refuse fulfilment of any submission where it reasonably suspects fraud, misuse, breach of these Terms, or inaccurate recipient information.

15. Participant Conduct Toward Others

Participants must not use the Campaign to submit or send content that is offensive, abusive, defamatory, harmful, or otherwise inappropriate.

Participants are solely responsible for their submissions and any impact on recipients.

We reserve the right to remove content and/or disqualify participants where misuse is suspected.

To the fullest extent permitted by law, Jacob’s shall not be liable for any harm, offence, or distress caused by user-generated content.

16. Force Majeure

Jacob’s shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond its reasonable control, including but not limited to:

  • Acts of God

  • Extreme weather

  • Industrial disputes

  • Supply chain disruption

  • Technical failures

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ireland.

Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.

18. No Cash Alternative

Products or promotional items associated with the Campaign are non-transferable, non-refundable, and no cash alternative will be offered except where required by law.

We process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Irish data protection laws.

We may collect and process the following personal data:
